Educational it was, both for Patty Hewes and viewers alike, as last night’s ‘Damages‘ proved that it can tell one helluva narrative without any of those pesky “six months from now” flashes. ‘Flight’s at 11:08′ isn’t the first episode to put the back and forth, past/present/future jumps on the back-burner, but it is the earliest it’s happened in a season. Normally, those narrative devices don’t fade away until the climactic moment later in the season when everything collides. What we got instead was a bit of different angle for ‘Damages’ as last night’s episode was driven by the characters and not the over-arching plot.

In many ways, the whole point of the hour was to lead us up to that final moment when Ellen called Patty. Despite Ellen’s feelings, these two of more alike that she’ll ever admit. On one side, we had Patty doing whatever it takes to find Danielle Marchetti while Ellen did all she could to focus on her family and distance herself from her work. It didn’t matter, though, because by the end of hour Ellen was only concerned about the same thing Patty was — did they get Danielle?
When it comes to Ellen’s family, for the most part, they’ve always been an afterthought. In the past, Ellen helped her dad when he had the car accident, we’ve seen her mother visit a few times, and the biggest moment was in the pilot when Ellen passed on her interview with Patty to attend her sister’s wedding.
Her parents (played to “oblivious to everything” perfection by Gordon Clapp and Debra Monk) obviously mean well, but more than anything, this episode served as an in-your-face reminder of the conversation that Patty had with Ellen at that wedding in the pilot — family always means well, and even though they may worship you and your accomplishments, at the end of the day, they’re always going to disappoint you.
So it came as no surprise for Ellen to see her mother in the dark, her dad perpetually angry, and her sister addicted to crystal meth. As guilty as it makes her feel, Ellen has risen above them and Patty knew it from the second she met her.
While all that was happening, Patty put on a tour de force performance as she expertly out-lawyered Leonard Winstone. The look on Martin Short’s face when Leonard realized he had been played was priceless — he’s more involved than anyone ever knew, until now. Kudos to Tom as well, for putting two and two together with the glass full of ice and realizing they had probable cause to pull over Joe Tobin’s car with the busted taillight.
Tom’s the same as Patty too — his life is falling apart and he’s broke, but all he could think about was the case. Now all they can do is hope that Danielle doesn’t die from her injuries or else it’s back to pulling teeth with Joe “I slept with Danielle first(!?)” Tobin.

As always, there were many developments this week on Damages. We’ll do our best to cover them below…
- The Tobin family has money, and Joe Tobin wants it. The alcoholic – we see him ask his sponsor for advice – is having trouble deciding if he should go to Patty Hewes with everything or if he should take care of his family. The character chooses family and tells his dad to set up whatever is necessary to get the Tobin money out there into an account Joe can dole out to family members. But Joe doesn’t wanna know any details about it.

- Through keen investigating, Tom tracks down the homeless guy who answered Patty’s cell call last week. He is led to a dumpster (the one in which his body is found six months later) where the homeless guy often finds stuff, such as a pair of boots Tom recognizes as belonging to Lou Tobin. Tom tracks down the store they are from and finds out that Lou bought a lot of clothing for someone with the initials “DMM.”
After asking Ellen to help at the DA office, Tom discovers that “DMM” stands for a woman named Michele. Lou was having an affair with her and is now hiding her at his daughter’s old home. When Joe finds this out, he falls off the wagon and drunkenly confronts Michele. Joe eventually leaves the residence, and actually backs over this woman on his way out. A bit of a stretch, but also a major problem now for Joe.
- There’s more Tom news to share: he’s broke! Tom learns that the investment company he had all his money in (and convinced his family to also invest in) was connected to Tobin and now all the money is gone. Tom confides this to his wife and to Ellen, but not to Patty.
- Patty has issues of her own, as she and Phil continue to argue over their divorce and who gets what. At one point, these two seem to get along well as they bond over their shared dog… but then Phil suggests the couple get back together, Patty totally shoots him down and he leaves in a huff. Interesting.
SIX MONTHS LATER
The main pieces of news this week’s flash forward shed light on were:
Tom’s body may have been found in a dumpster, but he died by drowning. The episode concludes on a shot of Ellen looking into the water, implying she had something to do with his death. We highly doubt this will prove to be the case. Earlier, in another flash forward, Ellen goes up Tom’s grieving wife and asks if anyone else knew about she and Tom.
Again, an affair is implied. But we’d wager heavily against one actually having taken place. Consider these prime examples of red herrings.

“Do you think this could have been done to you on purpose?” – Det. Vic Huntley
Patty Hewes for the people? No way. In tonight’s season three premiere of Damages, Patty (Glenn Close) may have been appointed by the government to recover billions of stolen assets from scheming financier Louis Tobin (Len Cariou), but let’s be honest here — this is Patty Hewes.

When her name is on the line, you better believe that’s all that matters. She’s set on finding all that money, but it’s to make her look good and has nothing to do with the welfare of Tobin’s thousands of victims. With a stellar record as of late (Frobisher and UNR), losing this battle would be a huge blow to Patty’s public image. So, knowing all that, what do you think about Det. Huntley’s question now? Could someone have tried to kill Patty on purpose?
It’s been ten months since the UNR case wrapped up and Ellen Parsons (Rose Byrne) bolted from Hewes & Associates for a public defender’s position at the D.A.’s office. But as luck would have it, Ellen’s new boss Curtis is determined to put Lou Tobin away immediately for his ponzi scheme crimes. The only problem with that? Patty needs Louis out of jail for as long as possible if she ever wants to find any money he may have hidden for his family. Talk about competing interests. Looks like Patty was right, though, because Ellen is back in the mix.
For the most part, tonight’s premiere was a lot of set-up for what’s to come in the season as a whole. We saw Ellen putting her law degree to some honorable use for once by trying to put away a drug dealer, but now that her boss knows she has ties to Patty, it’s doubtful that she’ll be doing anything other than work on the Tobin trial.
Much of the hour was spent introducing the Tobin clan, from Lou to his wife Marilyn (Lily Tomlin), son Joe (Campbell Scott) and daughter-in-law and Joe’s wife, Rachel (Reiko Aylesworth). All of them claim to have no knowledge of what Lou did and have been subjected to endless public humiliation. Patty seems to think otherwise, though, and in an attempt to gain some leverage on an already queasy Joe (Campbell Scott is nailing his part of the conflicted son and reluctant new family patriarch), she has one of his father’s victims pick a fight with him. Again, though, Patty says this is for the good of all the victims, and yes it is, but what’s it really about? Patty’s reputation, and that means doing whatever it takes. Ironically enough, probably the same mantra Louis Tobin followed for all those years.
The twists and turns were plentiful as Damages‘ signature time-shifting storytelling technique took us, and Patty, on quite the ride. In six months time, Patty is in a car accident where a mystery assailant drove right into her. She escaped with only a few bumps and bruises, but the fact remains — someone tried to kill her.
The car was registered to Tom (Tate Donovan), which immediately sounds weird since six months prior, Patty finally made him a partner. But in the future, we saw Tom living in a tiny apartment with nothing more than a mattress, empty water bottles, and lots of documents all over the floor. Where was his wife and son and his townhouse spread? And … who killed him? Huntley followed the homeless guy that was watching Tom’s apartment, and Tom’s body was found in a dumpster near where the homeless guy slept. What’s the connection? Could it have anything to do with Roger’s (Michael Gaston) assertion that this Tobin case is going to be bigger than any of them thought?

Damages is taking a big page from the Law & Order playbook.
The Glenn Close-starring drama is tackling a “ripped from the headlines” story as season three starts tonight on FX.
In this cycle’s case, Patty Hewes and Associates is tapped to represent the thousands of people who fell victim to a multibillion-dollar Wall Street investment fraud. Sound familiar? So who’s involved and what does it mean for our favorite legal antiheroine? Here’s what we can tell you:
Let’s just say the Ponzi Tobin family—played by the likes of Campbell Scott, 24’s Reiko Aylesworth and Lily Tomlin—has quite a bit in common with the Madoffs.
Close, for one, totally digs tackling such a topical issue.
“It’s really interesting. It will make people very interested in what our writers do with the subject,” she told us at a bash honoring the show’s season-two DVD release. “The fact that they’re exploring the family dynamic and the family politics is so cool.”
Yeah, Glenn Close totally said cool.
And while she insists “definitely the Tobins are not the Madoffs,” she thinks this season, which also features Martin Short in the dauntingly superserious part of the Tobin family attorney, could top the previous two.
“Not to disparage the others, I just think the writers have reached an amazing level. It’s almost like they’ve reached their stride,” she said.

* Ted Danson’s crooked, creepy and comical Arthur Frobisher won’t be showing up until midseason. He claims he knows very little about what he’ll be up to, but offered this tasty morsel: “I just shot two days. [Arthur's] written a book and a very famous Hollywood actor is interested in it. That’s all I know,” he swore. “And the odds are very good that his ego will get him in trouble again.”
* Timothy Olyphant’s gig as a love interest for Rose Byrne’s Ellen wasn’t exactly tied up in a bow at the end of last season, but the handsome Wes is nowhere to be seen in the first two episodes. According to Ebon Moss-Bachrach, who plays Ellen’s new potential romance, it’s not lookin’ good. “I haven’t seen him around,” he teased.
* Lastly, the gorgeous Aylesworth is sporting a jarring blond ‘do in her new role. Because we knew you’d be wondering, we asked if the change was some sort of directive from the show’s producers. “It was totally for me—this was breakup blonde,” she declared. “I’m still not a blonde [in my mind]. As I go darker, you’ll see my heart’s mending. It was much blonder right away.”
While Joe Tobin (Campbell Scott) decides between “family” and “integrity,” Patty and Tom dig deeper into Louis Tobin’s secrets. Tom gets a boost from Ellen in the effort but also receives some bad news relating to Louis Tobin. Meanwhile, Patty and Phil, locked in their bitter divorce battle, find one piece of common ground: their dog. Louis Tobin: Len Cariou. Winstone: Martin Short.

Damages star Glenn Close tells me she was “very upset” when she learned her show’s producers were killing off Tate Donovan’s characer, Tom Shayes, just as he’s made a partner in the firm. “I love Tate and my character, Patty, loved Tom,” says Close. “Tate’s done magnificently with a very tricky part and I’m just glad he’s getting a storyline this season he deserves.”
Even though the January 25 season premiere reveals Tom’s death, Tate says he will stick around all season. “You find out in the first episode that I’ve died and then the mystery is unveiled of how I was murdered,” he teases. “It’s going to be a fantastic season for me. I have 13 great episodes. His family life falls apart and I think it will be fun to see my character get into some very dark stuff.”
Tate, of course, would have preferred to keep his job. “It’s sad; a real bummer,” he shrugs. “When the producer called me, I told him, ‘That’s a great story – brilliant, if only it was happening to someone else.’”
Looking on the bright side, Tate, who previously appeared on Fox’s The OC, praises Damages as “one of the most favorite jobs I’ve ever had. I got to act, direct and work with the greatest writers in New York.”
